VOID - Digital Agency

Article 1 - Purpose

These Terms of Sale govern the contractual relationship between:

  • VOID, digital agency, located at 2 rue Racine, Casablanca, Morocco
  • And any individual or legal entity (hereinafter "the Client") wishing to acquire the services offered by VOID

Article 2 - Services

VOID offers the following services:

  • Digital audits (Express Diagnostic, Advanced Audit, Strategic Audit)
  • Web and mobile development (Drupal, React, native applications)
  • Digital strategy and UX Design consulting
  • Custom development and solution integration
  • Artificial intelligence and automation services

Article 3 - Pricing and payment terms

3.1 Prices: Prices are indicated in Moroccan dirhams (MAD) including all taxes. VOID reserves the right to modify its prices at any time, services being invoiced based on the rates in effect at the time of ordering.

3.2 Web pricing: A 20% discount ("Web Price") is applied to online orders for fixed-price audits.

3.3 Payment methods: Payment can be made:

  • By credit card online via the secure CMI platform (3D Secure)
  • By bank transfer (upon request)
  • Installment payments (quote only)

3.4 Security: Credit card payments are secured by the 3D Secure protocol. VOID does not store any banking data from the Client.

Article 4 - Order and confirmation

4.1 Ordering process: The Client selects the desired service and fills out the online form with their contact details. By validating their order, the Client expressly accepts these Terms of Sale.

4.2 Confirmation: An order confirmation is sent by email to the Client within 24 business hours.

4.3 Commitment: The order becomes firm and final upon receipt of full payment for fixed-price audits, or upon signature of the quote for custom projects.

Article 5 - Service execution

5.1 Deadlines: Execution deadlines are provided for information purposes when ordering or quoting. VOID commits to respecting these deadlines as much as possible, subject to the provision by the Client of necessary elements (access, content, validations).

5.2 Scoping: For audits, a 30-minute scoping call is organized within 24 hours after the order to define the scope and necessary access.

5.3 Deliverables: Deliverables (audit reports, developments, mockups) are transmitted to the Client by email or via a secure sharing space.

Article 6 - Right of withdrawal

In accordance with Moroccan law, professional Clients do not benefit from a right of withdrawal for fully executed services. For individual Clients, a 7-day right of withdrawal applies, unless service execution has begun with the express agreement of the Client before the end of the withdrawal period.

Article 7 - Refund and cancellation

7.1 Cancellation by Client: Any cancellation must be notified in writing (email). Paid amounts remain acquired by VOID if the service has already started. In case of cancellation before service start, a 50% refund will be made.

7.2 Refund: Refund requests are processed within 15 business days. The refund is made to the bank account used for payment.

7.3 Cancellation by VOID: VOID reserves the right to cancel an order in case of force majeure or technical impossibility. A full refund will then be made.

Article 8 - Intellectual property

8.1 Deliverables: Intellectual property rights on deliverables (source code, mockups, content) are transferred to the Client upon full payment of the project.

8.2 Reuse: VOID reserves the right to reuse generic components developed for other projects, without disclosing confidential or specific elements to the Client.

8.3 Reference: VOID may mention the Client in its commercial references and portfolio, unless written objection from the Client.

Article 9 - Confidentiality and personal data

9.1 Confidentiality: VOID commits to preserving the confidentiality of information communicated by the Client in the context of the service.

9.2 Personal data: Personal data collected (name, email, phone) are used only for service execution and are never transferred to third parties. The Client has a right of access, rectification and deletion of their data by contacting VOID.

9.3 GDPR: VOID complies with the General Data Protection Regulation (GDPR) for clients residing in the European Union.

Article 10 - Liability

10.1 Limitation: VOID's liability is limited to the amount paid by the Client for the relevant service. VOID cannot be held responsible for indirect damages (loss of revenue, loss of clientele, etc.).

10.2 Client obligations: The Client commits to providing accurate information and actively collaborating in project realization (providing content, validations, access).

10.3 Force majeure: VOID cannot be held responsible in case of force majeure or events beyond its control (server failures, natural disasters, etc.).

Article 11 - Claims and disputes

11.1 Claims: Any claim must be addressed by email to contact@void.ma within 15 days following service delivery.

11.2 Mediation: In case of dispute, parties commit to seeking an amicable solution before any legal action.

11.3 Jurisdiction: In the absence of amicable agreement, any dispute falls under the exclusive jurisdiction of the courts of Casablanca, Morocco.

Article 12 - General provisions

12.1 Modification: VOID reserves the right to modify these Terms of Sale at any time. Applicable Terms are those in effect on the order date.

12.2 Invalidity: If a clause of these Terms is declared invalid, other clauses remain applicable.

12.3 Language: These Terms are written in English. In case of translation, only the French version prevails.
